1. Introduction
These Terms and Conditions ("Terms") govern your use of the Vaya Con Data website (vayacondata.com) and the purchase of eSIM data plans ("Services") provided by Vaya Con Data ("we," "us," or "our"). By accessing our website or purchasing a plan, you agree to be bound by these Terms. If you do not agree, do not use our Services.
2. Eligibility
You must be at least 18 years old to purchase our Services. By placing an order, you represent that you are of legal age and have the authority to enter into this agreement. You are responsible for maintaining the confidentiality of any account credentials you create.
3. Device Compatibility
Our eSIMs require an unlocked, eSIM-compatible device. Compatible devices include:
- iPhone XS, XR, and newer (including all SE 2nd gen+)
- Google Pixel 3 and newer
- Samsung Galaxy S20 series and newer
- Most flagship Android phones from 2019 onward
It is your responsibility to verify your device is unlocked and eSIM-compatible before purchasing. You can check by going to Settings → Cellular/Mobile → "Add eSIM." If this option exists, your device supports eSIM. We are not responsible for purchases made on incompatible or carrier-locked devices, though we may offer refunds at our discretion (see our Refund Policy).
4. eSIM Purchase, Delivery & Activation
Upon successful payment, you will receive an eSIM QR code and activation instructions by email. Plans are delivered digitally — no physical product is shipped.
Activation: Your plan's validity period begins when your eSIM first connects to a supported network in the destination country. You can install the eSIM before traveling without starting the clock.
Each eSIM can typically be installed only once. If you delete or remove the eSIM from your device, it may not be recoverable. Contact support immediately if this occurs.
5. Data Plans & Usage
All plans are prepaid, one-time purchases. No subscription, no auto-renewal.
- Data-only plans: Provide mobile data only. No voice calls, no SMS.
- Voice+SMS plans: Include a French +33 phone number with unlimited calls and SMS within EU countries. Calls to non-EU numbers are not included.
- Hotspot/tethering: Supported on all plans.
- Speed: Full 4G/5G speeds. We do not throttle your connection.
- Data cap: When you reach your plan's data limit, service stops. No overage charges.
6. Payment Terms
All prices are listed in United States Dollars (USD). Payment is processed securely through Stripe. We accept Visa, Mastercard, American Express, Apple Pay, and Google Pay. Your payment information is never stored on our servers.
Prices are subject to change without notice, but the price at the time of your order will be honored.
7. Refund & Cancellation Policy
We offer refunds under the following conditions:
- Not yet activated: Full refund if your eSIM has not been installed and connected to a network. You have 14 days from purchase to request a refund.
- Technical issues: If the eSIM fails to work due to a fault on our end and we cannot resolve it within 24 hours, you are entitled to a full or partial refund.
- Incompatible device: If your device is not eSIM-compatible and the eSIM has not been activated, we will issue a full refund.
Not eligible for refund:
- Plans that have been activated (connected to a network) and partially or fully consumed.
- Change of mind after the 14-day window.
- Issues caused by your device, carrier settings, or local network restrictions beyond our control.
To request a refund, email support@vayacondata.com with your order reference. Refunds are processed to the original payment method within 5-10 business days.

8. Service Availability & Network
Our eSIMs operate on the Orange network and partner networks across Europe. Service is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted service, specific data speeds, or coverage in all areas. Service quality depends on factors beyond our control including network congestion, terrain, weather, and device capabilities.
9. Coverage Area
Our Europe plans cover 32 countries: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, and the United Kingdom.
10. Emergency Calls
Voice+SMS plans support standard calling within the EU. However, eSIM services may not support emergency calls (112, 911, etc.) in all circumstances. Always have an alternative method to reach emergency services. Data-only plans do not support any voice calling, including emergency calls.
11. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of local laws
- Resell, redistribute, or transfer your eSIM plan to third parties
- Use the Services in a way that damages, disables, or impairs network infrastructure
- Attempt to reverse engineer, scrape, or data-mine our platform
- Use the Services for automated machine-to-machine communication without authorization
12. Intellectual Property
All content on vayacondata.com — including text, graphics, logos, and software — is the property of Vaya Con Data and protected by copyright and trademark laws. You are granted a limited, non-exclusive license to use our website for personal, non-commercial purposes.
13. Limitation of Liability
To the maximum extent permitted by law, Vaya Con Data shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total liability for any claim shall not exceed the amount you paid for the specific plan giving rise to the claim.
14. Indemnification
You agree to indemnify and hold harmless Vaya Con Data and its affiliates from any claims, damages, or expenses arising from your violation of these Terms or misuse of our Services.
15. Termination
We reserve the right to suspend or terminate your access to our Services at any time for violation of these Terms, fraudulent activity, or any conduct that we deem harmful to our business or other users.
16. Governing Law
These Terms are governed by the laws of the Province of Ontario, Canada. Any disputes shall be resolved in the courts of Ontario.
17. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top indicates when changes were made. Continued use of our Services after changes constitutes acceptance of the new Terms. Material changes will be communicated by email where possible.
